DMV Hearing Victory

One of my clients received notice in the mail today that we successfully defended her license at the DMV last week.  In the last three business days, I have conducted three in-person DMV hearings.   Many attorneys claiming to be “DUI lawyers” rarely go through the trouble of showing up at the DMV to fight for their client’s license.  Instead, some lawyers conduct the hearing over the telephone with an expectation of losing.

If you or a loved one have been arrested for Driving Under the Influence of Alcohol or Drugs, you should demand utter preparation and hard work from your defense attorney.  In addition to trying to preserve your license at the DMV, I use the hearing as a discovery tool for the criminal case.  I will obtain the following evidence when it is available:

  • Police Reports;
  • 911 Calls and Call Log
  • Body Camera Video
  • Dash-Cam Video
  • Calibration Records for breath testing devices
  • Surveillance Video
  • Anything else the client and I can think of!

The DMV hearing also provides the criminal defense attorney an opportunity to cross-examine the arresting officer before a prosecutor ever has a chance to prepare him or her for trial.  The hearings are recorded and can be used as evidence in the criminal case.
