DMV Hearing Victories
I have recorded multiple DMV hearing victories for clients in recent weeks. Upon receiving the latest ruling today, one of our clients was spared a one-year hard suspension of his license. An adverse ruling would have been personally and professionally devastating to him.
I conduct a thorough investigation before defending a client’s license before the Department. I will obtain calibration logs, blood testing packets, body camera recordings, dash cam videos, investigation reports, arrest records, surveillance videos and any other item that may be helpful to securing a victory.
We also use skilled investigators when necessary to hunt down helpful witnesses.
I will aggressively litigate the case before the Department after obtaining all relevant and favorable evidence. To maximize my ability to confront the Department’s case, I often opt for an in-person hearing and subpoena the investigating police officer. In many cases, I will file a detailed brief that sets forth the legal and factual issues for the officer’s consideration well in advance of the hearing.
In our most recent victory, I filed a detailed written legal brief explaining why the Department should refrain from taking action against the client’s license. The brief identified numerous deficiencies in the police officer’s investigation. The Department’s forensic expert was also skillfully cross-examined and forced to concede that he could not render an opinion concerning the client’s blood alcohol concentration at the time of driving.
