The Ventura County Superior Court has proudly developed the best public website in California. Ventura County should be commended for providing ease of access to on-line court records.
One drawback to readily available public records arises when criminal defendants successfully move to get their criminal convictions expunged. At the present time, a prospective employer armed with a defendant’s full name and date of birth can jump on the internet and run a full criminal history check that will reveal an expunged case. Following an expungement, a client can find himself in jeopardy with a prospective employer after correctly and legally answering that he has no criminal conviction.
On July 17, 2015, I was a part of a group of criminal defense attorneys, prosecutors and court staff that met with judges in charge of overseeing Superior Court operations to address this problem. The Court was extremely receptive to finding a fix to the public access of expunged criminal convictions. We are confident that a technical solution will soon be acted upon that will protect expunged records from easy public internet access. The rest of Ventura County’s incredible website will remain untouched and available for public view.
